These terms govern your use of tivoly.pro and any service you commission from Tivoly Auto Trading Sdn. Bhd. (“Tivoly,” “we,” “our”). Please read them. If you instruct us in any way — visiting our showroom, sending an enquiry, or signing a sale agreement — you accept what is set out below.
1. The website
Content on tivoly.pro is published in good faith and updated regularly, but it is intended as a working overview rather than as a binding catalogue. Stock figures, prices and availability change daily. The authoritative figure is the one written on the floor sheet at the time of your visit.
2. Vehicle sale agreements
Every car we sell is supported by a written sale agreement signed by both parties before any transfer of funds. The agreement sets out the price, items included (road tax, insurance period, accessories), the 14-day mechanical assurance terms, and the JPJ transfer timeline. The website does not constitute an offer to sell; only the signed sale agreement does.
3. The 14-day mechanical assurance
Cars sold by Tivoly carry a 14-day mechanical assurance covering powertrain, electrics, brakes and air-conditioning. The assurance does not cover wear-and-tear items (tyres, wipers, brake pads worn beyond the 30% level), accidental damage, modifications carried out after handover, or items disclosed in writing on the floor sheet at the time of sale. Assurance claims are handled in our own workshop unless otherwise agreed.
4. Pre-purchase inspections
Inspection reports reflect the condition of the vehicle on the day of inspection. They are based on best practice but cannot guarantee the absence of intermittent or hidden faults. The report is for your benefit only; it may be shared with a seller but third parties may not rely on it without our written consent. Our liability for an inspection is capped at the fee paid for that inspection.
5. Vehicle appraisals
Written appraisals are an opinion of fair market value at a stated date, formed using the methodology summarised in the report. They are not a guarantee of any future sale price. Recipients (insurers, courts, executors) form their own conclusions; Tivoly is not liable for the use a third party makes of an appraisal we have prepared.
6. Trade-in offers
A trade-in offer is valid for seven calendar days from issue, subject to the vehicle remaining in materially the same condition. Cars that have accumulated significant additional mileage, suffered damage, or had components removed will require revaluation.
7. Payment
Vehicle sales settle by bank transfer; we do not accept cash sums above the limits set by Bank Negara Malaysia. Service fees (inspection, appraisal) may be paid by transfer or by major credit card. Receipts are issued at the time of payment.
8. Cancellation
You may cancel a booked inspection or appraisal up to 24 hours before the scheduled time without charge. Later cancellations attract a 50% cancellation fee to cover allocated technician time.
9. Intellectual property
All text, photographs, layout and code on tivoly.pro are the property of Tivoly Auto Trading Sdn. Bhd. or used under licence. You may share our pages on social media, but you may not republish or scrape the content without our written consent.
10. Liability
To the extent permitted by law, our total liability under any single engagement is limited to the fees paid by you for that engagement. Nothing in these terms attempts to limit liability for fraud or for matters that cannot be limited under Malaysian law.
11. Governing law
These terms are governed by the laws of Malaysia. Any dispute that cannot be resolved by discussion is subject to the exclusive jurisdiction of the courts of Wilayah Persekutuan Kuala Lumpur.
